Conditions related to the provision of digital marketing services.
By accessing the website and engaging the services of Kreativ Media, you agree to be bound by these Terms of Service. These terms dictate the relationship between Kreativ Media and the client regarding digital marketing retainers, projects, and consultations.
Kreativ Media provides premium digital marketing services, including but not limited to Search Engine Optimization (SEO), Pay-Per-Click (PPC) Management, Content Creation, and Social Media Marketing. The specific scope, timelines, and deliverables will be outlined in a separate Statement of Work (SOW) or retainer agreement negotiated between Kreativ Media and the client.
Due to the nature of digital marketing (especially SEO), timelines are estimates. Kreativ Media commits to executing strategies efficiently and professionally. However, external factors such as algorithm updates by search engines or ad platform policy changes are beyond the control of Kreativ Media and may impact project timelines and deliverables.
Clients are responsible for timely payment of agency retainer fees as outlined in their specific contract with Kreativ Media. Furthermore, clients are solely responsible for funding any advertising spend (e.g., Google Ads, Facebook Ads) directly to the platform. Kreativ Media does not front ad spend costs. Failure to maintain active billing on ad platforms will pause campaigns, and Kreativ Media cannot be held liable for resulting performance drops.
Both Kreativ Media and the client agree to maintain strict confidentiality regarding proprietary business processes, internal marketing metrics, and strategic plans shared during the duration of the engagement.
Either party may terminate the marketing engagement subject to the notice period defined in the master service agreement. Upon termination, Kreativ Media will transfer ownership of all created ad accounts, analytics dashboards, and finalized assets to the client, provided all outstanding invoices have been paid in full.
These terms shall be governed and construed in accordance with the laws under which Kreativ Media operates, without regard to its conflict of law provisions. Any disputes relating to marketing services rendered will be handled exclusively through designated legal channels established by Kreativ Media.
